Optimizing the Granting of Conditional Rights to Prisoners to Overcome Overcapacity in Correctional Institutions

Abstract


Overcapacity in correctional institutions is a serious problem in the criminal justice system in Indonesia, including in Class IIB Gunung Sugih Correctional Facility. This condition has an impact on the fulfillment of prisoners' rights and the effectiveness of the coaching program. This research aims to analyze the optimization of conditional rights as a solution to overcoming overcapacity in Class IIB Gunung Sugih Correctional Facility. The research method used is empirical research with a qualitative approach through observation and interviews. The results showed that the policy of granting conditional rights such as remission assimilation, conditional leave, and parole is an effective strategy for reducing prison overcapacity. However, the implementation of this policy still face obstacles such as the lack of understanding of prisoners about the procedures for applying for conditional procedures for applying for conditional rights and limited resources in prisons. Therefore, optimization efforts are needed through increased socialization of transparency in granting conditional rights and strengthening the rehabilitation-based correctional system.
